DEFYING what he considered to be threats to<br/>
his life, Bayelsa Resident Electoral<br/>
Commissioner (REC), Mr. Baritor Kpagih, has<br/>
revealed that he was offered money by<br/>
certain interests to skew the state’s<br/>
governorship election in favour of their<br/>
candidate.<br/>
<br/>
He disclosed that his refusal to be bribed had<br/>
pitted them against him.<br/>
<br/>
In an exclusive interview with The<br/>
Guardian , Kpagih said that he had been<br/>
receiving threats to his life since the<br/>
cancellation of the Southern Ijaw Local<br/>
Council poll results.<br/>
<br/>
Also, he denied a personal relationship with<br/>
former President Goodluck Jonathan, noting<br/>
that both of them were not in the Nigeria<br/>
Customs at the same time.<br/>
<br/>
The Bayelsa REC said that election should not<br/>
be seen as a do-or-die affair, but rather, as a<br/>
call to service. He told The Guardian: “Some<br/>
people tried to bribe me to help them win<br/>
the governorship election and this itself was<br/>
a misconception by these individuals.<br/>
<br/>
This is because there is no way I can help<br/>
anybody win an election. Mine was to<br/>
oversee the process. I can’t falsify results,<br/>
because they only come to the head office<br/>
after they have been collated at all other<br/>
levels. I only stay in the situation room and<br/>
oversee collation.’’<br/>
<br/>
He said those who had approached him to<br/>
swing the election in their favour were now<br/>
persecuting him and spreading all sorts of<br/>
false stories about him.<br/>
<br/>
‘‘I believe it was those who had tried to bribe<br/>
me before to help them rig the election that<br/>
are now behind all sorts of stories, being<br/>
bandied around about me. My refusal had<br/>
infuriated them and they started by saying I<br/>
was missing and that I have gone<br/>
underground and all sorts of stories.<br/>
People should not take election as a do-or-<br/>
die affair. I told them, I can’t help them to rig<br/>
the election and that they should use the<br/>
money they wanted to bribe me with to go to<br/>
the grassroots and canvass for the people’s<br/>
votes,” he said.<br/>
On the threats to his life, Kpagih said they<br/>
started after the election, but that they had<br/>
become more frequent in the last few days.<br/>
<br/>
‘‘Somebody called me on the phone and<br/>
threatened me and since then, I have been<br/>
receiving all sorts of threats. These have<br/>
come through text messages and others. Just<br/>
on Thursday, two strange people visited my<br/>
house in Yenagoa.<br/>
<br/>
They refused to identify themselves but told<br/>
my people that they had an appointment with<br/>
me and I knew for a fact that I didn’t have<br/>
any appointment with anybody that day.<br/>
<br/>
“Quite a number of people who are my<br/>
friends have advised me to avoid all the<br/>
hassles and stay away from Bayelsa State<br/>
because my safety cannot be guaranteed. But<br/>
I have a job to do and I am going to see it<br/>
through,’’ he said.<br/>
<br/>
On his alleged relationship with Jonathan, the<br/>
Ogoni-born electoral boss said he joined the<br/>
Customs Service a few years after Jonathan<br/>
had left the service and that at no time were<br/>
they ever course mates.<br/>
<br/>
He wondered why people would want to<br/>
malign his character, just because he had<br/>
decided to “fly straight.”<br/>
He advised politicians, ‘‘to concentrate on<br/>
what is expected to be done within the<br/>
framework of the law and Independent<br/>
National Electoral Commission (INEC)<br/>
guidelines for elections.<br/>
‘‘I joined the customs service as a graduate,<br/>
while Dr. Jonathan joined as a School<br/>
Certificate holder. He left the service around<br/>
1977 to go to the university. I also went to<br/>
the university in the same year and after<br/>
graduation, I joined the service, while he did<br/>
not return to the service.<br/>
‘‘The first time I met him was when he was<br/>
the vice president and we never had any<br/>
close relationship. I was retired prematurely,<br/>
seven years before the mandatory year. If he<br/>
was my close friend and he was the vice<br/>
president, wouldn’t he have helped me to<br/>
stay in service?’’ he queried.<br/>
On the violence that greeted the<br/>
governorship polls, Kpagih said that people<br/>
should look into the root causes of the<br/>
violent clashes, instead of looking for<br/>
scapegoats to heap blame on.<br/>
‘‘What keeps baffling me is the fact that up<br/>
till now, nobody is talking about the arms<br/>
and ammunition that were used to wreak<br/>
violence on the people. Nobody is looking<br/>
into how the arms got into Southern Ijaw and<br/>
who brought them into the area.<br/>
They were freely deployed into the<br/>
communities and nobody is talking about<br/>
those things,’’ he added.</div>

was on his way back from Church and<br/>
standing along Assemblies of God Church<br/>
junction in Alakahia, PH, when he was<br/>
allegedly hit by Police Van with registration<br/>
number NPF 1791D driven by Inspector John<br/>
Kanu.<br/>

“The police van after hitting the boy, tried to<br/>
drive off but were stopped by onlookers at<br/>
the junction and eyewitnesses who<br/>
demanded that the victim be taken to the<br/>
hospital.<br/>

The police agreed and took him to the<br/>
University of Portharcourt Teaching Hospital<br/>
(UPTH), but on reaching there, they allegedly<br/>
told the attending nurses that they just<br/>
picked him while they were driving along<br/>
NNPC Filling station at Rumuosi and they<br/>
weren’t aware of what had happened to<br/>

A 26-year-old man, Taiwo Oluwatobi, has been<br/>
arrested by the Lagos State Police Command, for<br/>
allegedly luring his Facebook lover to his house, and<br/>
raping her.<br/>
<br/>
PUNCH Metro learnt that Oluwatobi had met the 24-<br/>
year-old victim, identified only as Temitope, on<br/>
Facebook. He had allegedly lured her to his house in<br/>
the Alagomeji, Yaba area of the state to collect<br/>
N15,000, during which he raped her.<br/>
It was gathered that the incident happened at the<br/>
suspect’s friend’s rented apartment on Queens<br/>
Street, Alagomeji, on Monday, November 30, and the<br/>
visit was Oluwatobi and Temitope’s first meeting.<br/>
<br/>
It was gathered that the victim, who worked as a<br/>
printer in the Mushin area, told Oluwatobi, who she<br/>
reportedly met on Facebook around June 2015, that<br/>
she needed N15,000 to settle a debt.<br/>
The suspect was said to have invited the lady to<br/>
Alagomeji, to meet each other and also collect the<br/>
money.<br/>
Temitope was said to have arrived at the apartment<br/>
around 6pm and left at about 8pm, during which<br/>
Oluwatobi allegedly raped her.<br/>
<br/>
The victim was said to have reported the matter to<br/>
the Anti-Robbery Squad of the State Department of<br/>
Criminal Investigation, Yaba.<br/>
It was learnt that Oluwatobi, who hails from Ila<br/>
Orangun, Osun State, was arrested on Tuesday,<br/>
December 1.<br/>
According to the police, the suspect, said to be a<br/>
graduate of a university in Oyo State, was also a<br/>
suspected member of the Buccaneers’<br/>
Confraternity.<br/>
<br/>
It was gathered that the police also arrested the<br/>
suspect’s friend, Adenuga Adedayo, in whose<br/>
apartment the rape allegedly took place.<br/>
<br/>
Speaking with PUNCH Metro, Oluwatobi, who<br/>
worked as a caterer, said he had a consensual<br/>
sexual intercourse with Temitope, adding that he<br/>
saw the lady off when she was going back home.<br/>
<br/>
He said he was shocked that she reported the sex<br/>
as rape to the police.<br/>
He said, “We met on Facebook some months ago.<br/>
From Facebook, we began to talk on the telephone.<br/>
<br/>
That day was the first time we would meet, and we<br/>
had a sexual intercourse. She does printing jobs<br/>
and she stays in the Mushin area.<br/>
“She had asked me for N15,000, saying she had a<br/>
debt she needed to settle. I invited her to my area.<br/>
After the intercourse, she went to the police to say I<br/>
raped her. She was the one who told the police that<br/>
I was a cult member.<br/>
<br/>
“The reason for her coming was that I promised to<br/>
give her N15,000 to settle someone she owed<br/>
money. We had sex and at about 8pm, she left. My<br/>
friend was not at home that time and I see no<br/>
reason to tell him that somebody visited me.<br/>
<br/>
“I joined the Buccaneers Confraternity when I was<br/>
in 200-level in the university. I was just a member.<br/>
<br/>
After leaving school, I quit the group.”<br/>
The friend, Adedayo, from Ijebu Ode, Ogun State,<br/>
denied any knowledge of the rape, saying he<br/>
housed Oluwatobi for a week when he (Oluwatobi)<br/>
said he had a job to do in the area.<br/>
<br/>
He said, “The police accused me of housing a cultist<br/>
and his girlfriend, but I did not know about the<br/>
incident. I work in the Apapa area as a teacher. I did<br/>
not know he is a cultist. He had come to me to<br/>
assist him with accommodation, as he had a job in<br/>
our area. That was in the last week of November.”<br/>
<br/>
The Lagos State Police Public Relations Officer, DSP<br/>
Joe Offor, had yet to reply to a text message sent to<br/>
his phone on the incident.<br/>

for eight years from all football-related activity by<br/>
FIFA's ethics committee.<br/>

German judge Hans-Joachim Eckert, the chairman<br/>
of FIFA's adjudicatory chamber, held disciplinary<br/>
hearings for the pair last week and announced the<br/>
sanctions on Monday morning.<br/>
A FIFA statement read: "The adjudicatory chamber<br/>
of the Ethics Committee chaired by Mr Hans<br/>
Joachim Eckert has banned Mr Joseph S. Blatter,<br/>
President of FIFA, for eight years and Mr Michel<br/>
Platini, Vice-President and member of the<br/>
Executive Committee of FIFA and President of<br/>
UEFA, for eight years from all football-related<br/>
activities (administrative, sports or any other) on a<br/>
national and international level. The bans come into<br/>
force immediately.<br/>
<br/>
<br/>
"The proceedings against Mr Blatter primarily<br/>
related to a payment of CHF 2,000,000 transferred<br/>
in February 2011 from FIFA to Mr Platini. Mr<br/>
Blatter, in his position as President of FIFA,<br/>
authorised the payment to Mr Platini which had no<br/>
legal basis in the written agreement signed<br/>
between both officials on 25 August 1999. Neither<br/>
in his written statement nor in his personal hearing<br/>
was Mr Blatter able to demonstrate another legal<br/>
basis for this payment. His assertion of an oral<br/>
agreement was determined as not convincing and<br/>
was rejected by the chamber.<br/>
<br/>
<br/>
"The evidence available to the adjudicatory<br/>
chamber in the present case was not sufficient to<br/>
establish, to the extent required, that Mr Blatter<br/>
sought the execution or omission of an official act<br/>
from Mr Platini within the meaning of article 21<br/>
paragraph 1 of the FIFA Code of Ethics (FCE)<br/>
(Bribery and corruption). However, the conduct of<br/>
Mr Blatter towards Mr Platini without a legal basis<br/>
constituted a breach of article 20 paragraph 1 of<br/>
the FCE (Offering and accepting gifts and other<br/>
benefits). Furthermore, Mr Blatter found himself in<br/>
a situation of conflict of interest, despite which he<br/>
continued to perform his related duties, failing to<br/>
disclose said situation and the existence of<br/>
personal interests linked to his prospective<br/>
activities, thus violating article 19 paragraphs 1, 2<br/>
and 3 of the FCE (Conflicts of interest).<br/>
<br/>
<br/>
"By failing to place FIFA's interests first and<br/>
abstain from doing anything which could be<br/>
contrary to FIFA's interests, Mr Blatter violated his<br/>
fiduciary duty to FIFA and breached article 15 of<br/>
the FCE (Loyalty). Mr Blatter's actions did not<br/>
show commitment to an ethical attitude, failing to<br/>
respect all applicable laws and regulations as well<br/>
as FIFA's regulatory framework to the extent<br/>
applicable to him and demonstrating an abusive<br/>
execution of his position as President of FIFA,<br/>
hence violating article 13 of the FCE (General rules<br/>
of conduct).<br/>
"In consequence, Mr Blatter has been banned for<br/>
eight years from all football related activities and<br/>
fined CHF 50,000.<br/>
<br/>
"The investigation into the case of Mr Blatter was<br/>
conducted by Mr Robert Torres, member of the<br/>
investigatory chamber of the Ethics Committee.<br/>
<br/>
The investigation resulted in a final report which<br/>
was submitted to the adjudicatory chamber on 20<br/>
November 2015. The adjudicatory chamber opened<br/>
formal proceedings on 23 November 2015, and the<br/>
hearing of Mr Blatter took place in Zurich on 17<br/>
December 2015.<br/>
<br/>
"The proceedings against Mr Platini primarily<br/>
related to a payment of CHF 2,000,000 that he<br/>
received in February 2011 from FIFA.<br/>

 The payment<br/>
to Mr Platini had no legal basis in the written<br/>
agreement signed between both officials on 25<br/>
August 1999. Mr Platini's assertion of an oral<br/>
agreement was determined as not convincing and<br/>

"The evidence available to the adjudicatory<br/>
chamber in the present case was not sufficient to<br/>
establish, to the extent required, that Mr Platini<br/>

Nevertheless, the conduct of Mr Platini without a<br/>
legal basis constituted a breach of article 20<br/>
paragraph 1 of the FCE (Offering and accepting<br/>
gifts and other benefits). Furthermore, Mr Platini<br/>
found himself in a situation of conflict of interest,<br/>
despite which he continued to perform his related<br/>
duties, failing to disclose said situation and the<br/>
existence of personal interests linked to his<br/>
prospective activities in violation of article 19<br/>
paragraphs 1, 2 and 3 of the FCE (Conflicts of<br/>
interest).<br/>
"By failing to place FIFA's interests first and<br/>
abstain from doing anything which could be<br/>
contrary to FIFA's interests, Mr Platini also violated<br/>
his fiduciary duty to FIFA and breached article 15<br/>
of the FCE (Loyalty). In addition, Mr Platini failed to<br/>
act with complete credibility and integrity, showing<br/>
unawareness of the importance of his duties and<br/>
concomitant obligations and responsibilities. His<br/>
actions did not show commitment to an ethical<br/>
attitude, failing to respect all applicable laws and<br/>
regulations as well as FIFA's regulatory framework<br/>
to the extent applicable to him and demonstrating<br/>
an abusive execution of his position as Vice-<br/>
President of FIFA and member of the FIFA<br/>
Executive Committee, hence violating article 13 of<br/>
the FCE (General rules of conduct).<br/>
"In consequence, Mr Platini has been banned for<br/>
eight years from all football related activities and<br/>
fined CHF 80,000.<br/>
<br/>
"The investigation into the case of Mr Platini was<br/>
conducted by Ms Vanessa Allard, member of the<br/>
investigatory chamber of the Ethics Committee.<br/>
<br/>
The investigation resulted in a final report which<br/>
was submitted to the adjudicatory chamber on 20<br/>
November 2015. The adjudicatory chamber opened<br/>
formal proceedings on 23 November 2015, and the<br/>
hearing took place in Zurich on 18 December 2015<br/>
in the presence of Mr Platini's lawyers."</div>
